TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your use of www.thedessertjunkie.com and all orders, custom cake bookings, catering engagements, and mobile truck services provided by The Dessert Junkie Bakery, a Maryland business ("The Dessert Junkie," "we," "us," or "our"). By using this website, submitting an order or quote request, or paying a deposit or invoice, you ("Customer" or "you") agree to these Terms.

Please read them carefully. If you do not agree, please do not place an order.

ARTICLE 1. ORDERS AND ORDER ACCEPTANCE

1.1 Menu Orders. Cakes, cupcakes, cookies, pies, ice cream, and other items from our standard dessert menu may be ordered in the bakery, by phone, or through our website, subject to availability. Menu items, flavors, and seasonal offerings may change without notice.

1.2 Custom Orders. All custom cake and specialty orders begin with a quote request submitted through our website form or by email. We respond to quote requests within approximately 48 hours. A quote request is an inquiry, not a confirmed order.

1.3 When an Order Becomes Binding. An order is confirmed only when we have (a) issued an invoice and order summary, and (b) received your deposit. Until both occur, no date, design, or delivery window is reserved. We accept orders on a first-come, first-reserved basis and reserve the right to decline any order.

1.4 Lead Time. We recommend booking one to two weeks in advance, and earlier during our peak seasons of April through June and September through December. Rush orders may be accepted at our discretion and may carry an additional fee.

1.5 Order Accuracy. You are responsible for the accuracy of all order details, including spelling on inscriptions, event date and time, guest count, delivery address, and contact information. We prepare orders based on the written order summary provided to you. Please review it carefully; errors not identified before production begins cannot be corrected without additional charge.

ARTICLE 2. PRICING, DEPOSITS, AND PAYMENT

2.1 Pricing. Custom cakes start at $150 and are priced based on size, design complexity, ingredients, and labor. Pricing quoted is valid for [30] days unless otherwise stated. Prices are subject to Maryland sales tax where applicable.

2.2 Deposit. A non-refundable deposit of $75.00 is required for all custom cake orders. The deposit reserves your date and covers design consultation and materials planning, and is applied toward your total balance.

2.3 Final Balance. The remaining balance is due no later than 1 days before your pickup or delivery date. Orders with unpaid balances may not be released or delivered.

2.4 Payment Methods. Payment is processed through Square, our point-of-sale and invoicing provider, and through the checkout tools on our website. We do not store your full card information. Returned payments or chargebacks may incur a fee and may result in cancellation of the order.

2.5 Catering and Event Deposits. Catering, dessert bar, Bite Bar, and mobile truck bookings require a deposit of 50% of the estimated total to reserve the date, with the balance due 1 days before the event. Deposits for event bookings are non-refundable.

ARTICLE 3. CHANGES, CANCELLATIONS, AND REFUNDS

3.1 Changes to an Order. Requests to change flavors, size, or design must be submitted in writing and are subject to our approval and availability. Changes requested within 3 days of the pickup or delivery date may not be possible, and changes that increase size or complexity will increase the price.

3.2 Customer Cancellation. Deposits are non-refundable. If you cancel more than 3 days before your date, any amount paid above the deposit will be refunded. Cancellations within 5 days of the date forfeit all payments made, because ingredients have been purchased and production time has been reserved.

3.3 Cancellation by Us. In the rare event we must cancel an order due to equipment failure, illness, supply shortage, or another circumstance beyond our control, we will notify you as soon as possible and refund all amounts paid, including the deposit. This refund is our full and complete liability for a cancelled order.

3.4 Perishable Goods. Because our products are perishable and made to order, all sales are final. We do not accept returns or offer refunds based on taste, flavor, or personal preference.

3.5 Concerns With an Order. If you believe there is a defect in your order, please contact us within 24 hours of pickup or delivery and, where possible, retain the product and provide photographs. We will review each concern in good faith. Any remedy is at our discretion and will not exceed the purchase price of the item.

3.6 Uncollected Orders. Orders not picked up within 24 hours of the scheduled pickup time are forfeited without refund, as we cannot safely hold or resell perishable custom products.

ARTICLE 4. CUSTOM DESIGN

4.1 Artistic Interpretation. Each cake is handmade. Reference or inspiration images shared with us are used as a guide, not a guarantee of an exact reproduction. We will not copy another baker's or artist's work outright, and finished designs will reflect our own artistry and technique.

4.2 Color and Finish Variation. Colors, shades, and finishes may vary from screen images, printed swatches, or prior work. Certain deep or saturated colors may not be achievable in all mediums and may affect taste.

4.3 Fresh Florals and Décor. Fresh flowers, greenery, and non-edible décor may be used as design elements. Unless we source them, we are not responsible for the condition, safety, or food-grade status of florals or décor supplied by you or by a third-party vendor.

4.4 Non-Edible Elements. Cakes may contain non-edible structural or decorative components, including dowels, boards, wires, supports, ribbon, and toppers. These items must be removed before serving. You are responsible for removing them and for informing anyone who cuts or serves the cake.

4.5 Design Approval. Once production has begun, the design is final. We may photograph work in progress for our records.

ARTICLE 5. PICKUP AND DELIVERY

5.1 Pickup. Orders may be picked up at 15480 Annapolis Road, Suite 204, Bowie, MD 20715 during our scheduled pickup hours. Please bring your order confirmation. We recommend transporting cakes on a flat surface in an air-conditioned vehicle.

5.2 Delivery Area. We deliver within the Washington, D.C. metropolitan area only. Standard delivery is available within approximately 15 minutes of the bakery; custom order delivery is available within approximately one hour of the bakery. Order minimums apply to deliveries beyond 15 minutes.

5.3 Delivery Fees. Delivery fees begin at $50 and range up to $350 or more depending on order size, distance, and timing. Your fee will be confirmed on your invoice before the order is accepted.

5.4 Delivery Windows. Delivery times are estimates. We are not responsible for delays caused by traffic, weather, road closures, venue access restrictions, or other conditions outside our control.

5.5 Receipt of Delivery. Someone must be available at the delivery address to accept and sign for the order at the scheduled time. If no one is available, we may leave the order with venue staff where authorized, or return it to the bakery. Redelivery is subject to an additional fee, and we are not responsible for the condition of an order left with a third party.

5.6 Risk of Loss. Risk of loss and responsibility for the product transfer to you at the moment of pickup or delivery. Once a cake has been picked up, delivered, set up, or handled by you, your venue, or another vendor, we are not responsible for damage, melting, collapse, tipping, improper storage, or improper handling.

ARTICLE 6. CATERING, EVENTS, AND MOBILE TRUCK

6.1 Estimates and Final Counts. Catering, dessert bar, and Bite Bar bookings are quoted based on guest count and menu selections. Final guest counts and menu selections are due 3 days before the event. Increases after that date are subject to availability; decreases will not reduce the invoiced amount.

6.2 Venue Requirements. You are responsible for securing venue access, loading access, adequate table space, shelter from direct sun and heat, and any permits, insurance certificates, or vendor approvals the venue requires. Mobile truck bookings additionally require adequate level parking space, clearance, and access as specified in your booking confirmation.

6.3 Site Conditions. We are not responsible for product quality issues resulting from venue conditions outside our control, including heat, humidity, direct sunlight, or lack of refrigeration.

6.4 Setup and Breakdown. Setup and breakdown times will be confirmed in your booking. Additional time on site beyond the confirmed window may be billed at our standard hourly rate.

6.5 Rented Equipment. Stands, displays, trays, linens, and similar items provided by us remain our property and must be returned in the condition received. Missing or damaged items will be billed at replacement cost.

ARTICLE 7. FOOD SAFETY, ALLERGENS, AND STORAGE

7.1 Allergen Notice. We work in a commercial kitchen that handles wheat, dairy, eggs, nuts, peanuts, soy, and other allergens. While we follow best practices for preparing and storing gluten-free, dairy-free, and nut-free items, we cannot prevent airborne cross-contact — flour, for example. Our products may not be suitable for those with severe or life-threatening allergies.

7.2 Dietary Requests. Nearly all of our cakes can be made gluten-free, and a vegan menu is available on request. "Gluten-free" and similar descriptions reflect the ingredients selected for your order, not a certified allergen-free production environment.

7.3 Your Responsibility. You are responsible for informing your guests and anyone serving your order about ingredients and allergen risks. Ingredient information is available on request.

7.4 Storage and Handling. Products should be kept refrigerated or at the temperature we specify, protected from heat and direct sunlight, and consumed within the timeframe we provide. We are not responsible for product quality or safety after it leaves our control.

ARTICLE 8. INTELLECTUAL PROPERTY AND PHOTOGRAPHY

8.1 Our Content. The Dessert Junkie name, logo, website content, photographs, menu descriptions, and original cake designs are our property and may not be copied, reproduced, or used commercially without our written permission.

8.2 Photography of Your Order. We reserve the right to photograph completed orders and to use those images on our website, social media, and marketing materials. We do not publish customer names, addresses, or event details without permission. If you prefer that we not photograph or post your order, tell us in writing before your event date and we will honor that request.

8.3 Materials You Provide. By submitting images, logos, artwork, or text for use on a custom order, you confirm that you have the right to use them and that they do not infringe anyone else's rights. We may decline any request to reproduce trademarked or copyrighted characters, logos, or artwork.

ARTICLE 9. WEBSITE USE

9.1 Accuracy. We work to keep menu, pricing, and availability information current, but content on this site may contain errors or become outdated. We reserve the right to correct errors and to cancel any order placed based on incorrect pricing or availability information, with a full refund.

9.2 Acceptable Use. You agree not to use this site for any unlawful purpose, to interfere with its operation, or to attempt to gain unauthorized access to any part of it.

9.3 Third-Party Platforms. Our website is hosted on Wix and our payments are processed by Square. Your use of those platforms is also subject to their terms and policies. We are not responsible for outages, errors, or security incidents originating with third-party platforms.

9.4 Privacy. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

ARTICLE 10. LIMITATION OF LIABILITY AND WARRANTIES

10.1 As Is. Except as expressly stated in these Terms, our products and services are provided "as is," without warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

10.2 Limit of Liability. To the fullest extent permitted by Maryland law, our total liability arising out of any order, event, or use of this website is limited to the amount you paid for the order or service at issue.

10.3 No Consequential Damages. We are not liable for indirect, incidental, special, or consequential damages, including event costs, venue fees, lost profits, or emotional distress.

10.4 Force Majeure. We are not liable for failure to perform due to circumstances beyond our reasonable control, including severe weather, natural disaster, fire, power or equipment failure, illness, labor disruption, supply shortage, vehicle breakdown, or government order. In those circumstances we will make reasonable efforts to fulfill your order or will refund amounts paid.

ARTICLE 11. GOVERNING LAW AND DISPUTES

11.1 Governing Law. These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.

11.2 Resolution. The parties will first attempt to resolve any dispute informally by contacting us at orders@thedessertjunkie.com. If a dispute cannot be resolved informally, it will be resolved in the state or federal courts located in Prince George's County, Maryland, and both parties consent to that venue.

11.3 Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

ARTICLE 12. CHANGES TO THESE TERMS

We may update these Terms at any time. The version in effect on the date your order is confirmed governs that order. The "Last updated" date above reflects the current version, and we recommend checking this page periodically.

These Terms, together with your order summary and invoice, constitute the entire agreement between you and The Dessert Junkie Bakery regarding your order.
